JOB SEEKER TERMS

The following terms of use (“Job Seeker Terms”) apply to you (“You”, “Your”) when You use Job Advertising Services (“Services”) operated by Talentify  Inc. (“Talentify”, “We”, “us”, “our”). By accessing or using our Services, you agree to these Terms of Use, our Privacy Policy, General Terms and Shortcode Terms of Use.

As a Job Seeker, you consent to your responses, interest, applications, and any other communications sent being processed and analyzed by Talentify according to these Terms of Use and Talentify’s Privacy Policy, General Terms of Use and Shortcode Terms of Use. You are requesting and authorizing Talentify to make your response available to the Employer through Talentify’s Site and Services.

  1. Job Ads or Job Listings 

Individuals searching for employment opportunities (“Job Seekers”), may access Job Postings and or Job Advertisements advertising employment opportunities and other job-related content, including links to third-party websites (“Job Listings” or “Job Ads”) hosted by Talentify for free. You acknowledge and understand that Talentify has no control over the content of Job Postings or Job Advertisements, links to or from Job Postings or Advertismements, or any conditions third parties might impose once a Job Seeker has submitted an application. Talentify assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Postings or Job Advertisements, Company Pages, and assessments. Once you provide information to an Employer (whether in the form of a job application, resume, email, or otherwise), Talentify does not have control over the Employer’s use or disclosure of that information. If you want to request the Employer delete, modify, or maintain confidence over any such information, you must make such a request directly to the Employer.

  1. Communications and Other Actions

You may receive messages, including but not limited to text messages, emails or email notifications corresponding with your activity. Talentify’s Privacy Policy and Shortcode Terms of Use will apply to all of these communications.

YOU UNDERSTAND AND AGREE THAT THERE IS NO PROTECTION FOR ANY INFORMATION YOU SHARE OR DATA THAT YOU TRANSMIT INCLUDING, BUT NOT LIMITED TO, AUDIO/VISUAL CONTENT, INTERVIEW QUESTIONS AND ANSWERS, OR YOUR IMAGE OR LIKENESS. YOU ACKNOWLEDGE AND AGREE THAT TALENTIFY IS NOT RESPONSIBLE FOR SECURING OR PROTECTING ANY DATA OR INFORMATION THAT YOU SHARE OR TRANSMIT. TALENTIFY ASSUMES NO LIABILITY FOR THE MISUSE OF ANY DATA YOU SHARE OR TRANSMIT.

When you visit our website Talentify.io or app.talentify.io, and use our services, you trust us with your personal information. We take your privacy very seriously. Your privacy protection is outlined in full in Talentify’s Privacy Policy.

What Personal Data (“Your Personal Data”) are we Collecting?

  • Data that you input during the application process or job alert creation (contact information, experience and education, attachments, screening questions answers).
  • Your IP Address is used but not saved.
  • Cookies, which allow us to know how our services are accessed and used (i.e. the pages of our website that You visit, which career sites and job boards You visit, which application processes You have started).

What is the Purpose of Collecting Your Personal Data?

  • Help You manage Your job opportunities: when You apply to one of our Customers, You have access to an application link where You can find Your profile information and applications information. In this case we are the data controller
  • Help our customers (“Customer”) find their next hires : when You apply, our Customer (the recruiter or hiring manager or interviewer) can consider You for any job opportunities they have and can use any Talentify tools to track, manage and make a decision. In this case, the Customer is the data controller.
  • Receive jobs suggestions available from and through Talentify.
  • Conduct surveys: Talentify  may also contact You via surveys to conduct research about Your opinion of current or future Talentify functionalities and user experience.
  • Improve and develop services and products: Talentify may use the Personal Data to improve and develop its services and products to the extent this is necessary.

Tracking Cookies

Talentify may use “cookies” to help You personalize Your online experience. A cookie is a text file that is placed on Your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to Your computer. Cookies are uniquely assigned to You, and can only be read by a web server in the domain that issued the cookie to You. One of the primary purposes of cookies is to provide a convenience feature to save You time. The purpose of a cookie is to tell the Web server that You have returned to a specific page. For example, if You personalize Talentify pages, or register with Talentify site or services, a cookie helps Talentify to recall Your specific information on subsequent visits. This simplifies the process of recording Your Personal Data, such as Login information. When You return to app.talentify.io, the information You previously provided can be retrieved, so You can easily use the Talentify features that You customized.

You have the ability to accept or decline cookies.

Retention of Your Personal Data

A Customer, to which you have applied for a job through Talentify’s services, may decide which data retention period they observe to comply with its legal obligations (for example, if they are required to retain Your Personal Data to comply with applicable local laws) and resolve disputes.

  1. Liability 

NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, OUR SOLE LIABILITY FOR ANY REASON TO YOU, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OR CLAIM WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE THREE-MONTH PERIOD PRIOR TO ANY CLAIM.

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW. PLEASE REFER TO YOUR LOCAL LAWS FOR ANY SUCH PROHIBITIONS.

UNLESS PROHIBITED BY APPLICABLE LAW, YOU AGREE TO INDEMNIFY AND HOLD HARMLESS EACH OF TALENTIFY, ITS PARENTS, SUBSIDIARIES, AFFILIATES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEYS’ FEES, RESULTING FROM OR RELATED TO (1) YOUR USE OF THIS SITE OR ANY SERVICES, (2) THE VIOLATION OF THESE TERMS OF USE BY YOU, OR (3) THE INFRINGEMENT BY YOU, OR ANY OTHER USER USING YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY. IF YOU ARE OBLIGATED TO INDEMNIFY US HEREUNDER, WE MAY, IN OUR SOLE DISCRETION, (1) CONTROL THE DEFENSE AND DISPOSITION OF ANY SUCH CLAIMS AT YOUR SOLE COST AND EXPENSE OR (2) REQUIRE YOU TO DEFEND TALENTIFY WITH COUNSEL OF OUR CHOOSING. WITHOUT LIMITING THE FOREGOING, YOU MAY NOT SETTLE, COMPROMISE OR IN ANY OTHER MANNER DISPOSE OF ANY THIRD-PARTY CLAIM WITHOUT OUR CONSENT.

  1. Governing Law

These Terms of Use and your use of the Site and Services will be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to its conflicts of law provisions. By accessing or using the Site or Services, you consent and submit to the exclusive jurisdiction and venue of the state and federal courts located in Delaware. A printed version of these Terms of Use will be admissible in judicial and administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

  1. Disputes

You are solely responsible for your interactions with other users of the Site or the Services. We reserve the right, but not the obligation, to monitor disputes between you and other users.

You may not take legal action against Talentify without first (a) sending us, a detailed written description of the facts and law out of which your claim arises; and (b) negotiating with us, in good faith, toward resolution of the dispute.
