SERVICE TERMS

The following Service Terms apply to Customer to the extent the specific Service is included in the applicable order form.  Talentify may update these Service Terms from time to time. Talentify reserves the right to upgrade, update or discontinue any aspect or feature of a Service in whole or in part; provided, however, that if Talentify discontinues a Service in whole during the term of an order form then Talentify will provide Customer with an alternative or replacement service.

The Job Advertising, Job Postings and Job Slots Services (collectively, the “Talentify Services”) are designed to help Customer reach quality candidates for job opportunities. Job Postings will expire upon the expiration/termination of the ordering document. Customer is responsible for (i) all postings and content through the Talentify Services or otherwise to Talentify , including but not limited to the job descriptions, creatives, trademarks, images, URLs and pixels that comprise the postings or content therefor (collectively, the “Postings”); and (ii) all content and property to which Postings may direct viewers, as well as redirects (“Destinations”).

Organic Job Distribution provides access to SEO (including Google for Jobs), Jobs on Facebook Organic Optimization, Linkedin Organic Jobs Optimization and Indeed Organic Jobs Optimization. Jobs are optimized for each environment and provide a mobile first and desktop application experience for candidates. Talentify’s Organic job distribution does not limit the number of candidates per advertised job and seeks to convert as many quality candidates as possible and redirect them to your ATS to complete your full job application.

Sourcing Slots Talentify Sourcing Slots and Premium Sourcing Slots operate on a fixed price per slot and leverage all the prequalifying and engagement capabilities of the usual Talentify experience, but add automation for rotation of positions - maximizing the exposure of open positions, and efficiently cycling out jobs that have met their order volume and replacing them with like for like roles. Each slot is determined by the campaign criteria set by the campaign creator, and will rotate through this criteria per slot on an unlimited basis.

 

Talentify Exchange operates on campaigns set and automatically deploys job marketing strategies depending on the level and complexity of a job, job channels may include:

  • Pay-per-click campaigns
  • Job boards  and Aggregators

Jobs are added to campaigns to use on the job advertising channels. The budgets added to campaigns activate programmatic job advertising:

  • A campaign and its budget will remain in effect until all requested candidates are identified for that campaign, or the campaign maximum budget is exhausted - whichever comes first
  • Month end billing for completed programmatic job advertising will be based on the data contained within the Talentify platform
  • Talentify will provide cost per candidate per campaign

Indeed Sponsored Jobs Management Talentify optimizes the Indeed Apply experience for sponsored jobs. Managing programmatic bidding for sponsored jobs and adding the usual Talentify engagement and pre-qualifying experience to Indeed applications. Candidate applications are delivered to the client Applicant Tracking System.  Operating under a specific Insertion Order (IO) Talentify provides a fully managed service on Indeed for customers job openings. IO highlights the spending authority each month for Talentify on customer behalf

Sponsored Jobs Management Talentify optimizes the Apply experience for sponsored jobs. Managing programmatic bidding for sponsored jobs and adding the usual Talentify engagement and pre-qualifying experience to Indeed applications. Candidate applications are delivered to the client Applicant Tracking System.  Operating under a specific Insertion Order (IO) Talentify provides a fully managed service for customers job openings. IO highlights the spending authority each month for Talentify on customer behalf

Dynamic Cost Per Candidate The Talentify programmatic job advertising solution operates on the committed budget per campaign and will always optimize job channels. The goal is to provide the most cost-effective way to provide the highest number of quality candidates for each advertised job. This could mean that for jobs and locations with a greater supply of candidates, the price per candidate might be lower, and for jobs and locations where access to talent is limited, the price per candidate might be higher.

Customer may not resell or transfer access to the Talentify Services to any other party. Customer agrees that it will not, and will not enable or authorize any third party, by virtue of the Postings, Destinations, or use of the Talentify Services, to:

  • Create Postings without a reasonable and legitimate intent to hire for a bona fide job opportunity or the specific position listed;
  • Create Postings that intentionally misrepresent the job, hiring company or poster;
  • Fail to clearly disclose in any Posting that a position is for an independent contractor or is part-time, piecework, commission-based, or has otherwise nontraditional working conditions or compensation may constitute intentional misrepresentation;
  • Create Postings for “business opportunities” that require payments or recruitment of others or that resemble franchises, multi-level marketing, club memberships, distributorships, or are entirely or almost entirely commission-based;
  • Provide identifiable candidate resume or application data to any other parties;
  • “Spam” or otherwise contact applicants for purposes other than related to the specific employment opportunity described in the posting;
  • Harass, stalk, or contact any applicant after they have asked not to be contacted;
  • Create Postings in the United States without possessing valid Federal or State Employer Identification Numbers, if applicable, or create Postings in any other location in a manner that would not allow compliance with applicable tax and employment laws;
  • Create Postings for jobs that require applicants to pay for employment or otherwise bear costs related to employment in violation of applicable law;
  • Soliciting employees by intentional misrepresentation;
  • Create Postings, advertise employment positions, or otherwise engage in recruitment or hiring practices that would be a violation of the law in Customer’s state or country, the state or country where the job is to be performed, or the applicable laws of the jurisdiction that governs the SA between the parties;
  • Engage in solicitations, communications or transactions that violate any applicable laws or regulations related to the prohibition of employment discrimination, or that violate applicable laws governing legal eligibility to work;
  • Engage in illegal or fraudulent conduct;
  • Except as expressly authorized by Talentify in writing, use any automated means or form of scraping or data extraction to access, modify, download, query or otherwise collect information fromTalentify ’s websites;
  • Copy, modify or create derivative works of the Talentify Services or any related technology; or
  • Create Postings that contain malware, spyware or any other malicious code or otherwise interfere with the operation of the Talentify Services or any device or system or breach or circumvent any security measure of Talentify or a third party.
